Our Terms of Service

Welcome to our website. These are the terms of service regulating your use of www.cohostmarket.com, our website dedicated to connecting homeowners and professional Airbnb property managers. You hereby agree to be fully and legally bound by these terms of service anytime you access, browse, list your property or services on, or use the CoHostMarket.com platform in any other way. We ask you not to use this website if you disagree in any way with any of the following terms.

CoHostMarketplace is an online platform that allows homeowners on the Airbnb platform connect with and hire professional managers for the purpose of managing their properties.

You however understand and accept that we are not ourselves property owners, neither do we operate in the capacity of a property manager. Our services entail and are limited to facilitating a connection between Airbnb homeowners and professional managers. We operate in 190 countries.

 

BASIC DEFINITIONS

a) Under these terms of service, these following words/phrases shall be thus defined:

b) Us/we: Used interchangeably, this shall mean CoHostMarket.com

c) Host: A homeowner who makes his home available for Airbnb services and who uses the CoHostMarket.com platform to connect with a professional property manager/Co-host.

d) Co-host: This shall refer to a professional property manager who uses CoHostMarket.com to connect with a Host/homeowner for the purpose of managing the homeowner’s property, as advertised on Airbnb.

e) User: This shall refer to both host and co-host

f) You/your: Used interchangeably, this means a user, whether a host or a co-host

g) Guest: This shall refer to a fee-paying individual who leases a host’s home as per Airbnb’s policies.

 

ACCEPTABLE USE OF THE WEBSITE

We grant Co-Host Marketplace users a limited, non-exclusive, reversible, non-assignable, non-sublicensable license to use the website in compliance with these terms of service.

The copyright in all the materials found on this website is held by CoHostMarket.com. We allow users to copy and download materials from our website for both personal and non-personal, money-making use, with the proviso that such materials are not modified or altered and that all copyright and proprietary notices within such materials are kept as they are. This permission automatically ends if you violate any of these provisions.

You may not republish, display, replicate, disperse, transmit or dispatch any of the content in any form or by any means, which may include but is not constrained to recording, automation, electronic photocopying, or in any other way without the express permission of CoHostMarket.com.

We provide the CoHostMarket.com website only for persons who have reached the legal age of 18 and are able to form legally binding contracts according to US laws and other international laws. We will also require you to register an account on the website. For the purpose of payments of fees and commissions, you must also hold a valid debit/credit card.

 

USER ACCOUNTS

To be able to use some parts of our website as a host or a co-host, we will request you to fill a registration form, and this will require you to provide private information like name, country of residence, e-mail address, home address, phone number and bank/payment details/information.

1) You must specify whether you are registering as a homeowner or as a professional property manager.

2) You hereby attest that any private information that you provide to us, during and after the registration process are complete, honest, and accurate. Once we receive your request to register an account with us, we will determine in our sole discretion whether to grant that request or not.

3) You understand and accept that granting the ability to open user accounts or otherwise shall be done at our discretion, without the need to give reasons as to our final decision and decision-making process.

4) We may ask for additional information, materials and documentation from any user, as we, in our discretion, deem necessary.

5) After registration has been completed, we may erase your account if your personally provided information is found to be wrong, false or deliberately misleading.

6) Once registered, CoHostMarket will give you access to a personal CoHostMarket user account. We expect you to keeps your account information safe and secure once the registration process is complete. Every activity that is connected with your personal CoHostMarket account shall be deemed your responsibility, and you must at all times maintain the safety and confidentiality of your CoHostMarket account details.

7) You are mandated to immediately notify us if you believe that an unauthorized third party has breached the confidentiality of your account without authorization.

8) You understand and accept that we have the rights to monitor conversations between users, and that we may at any time without prior notice request any user to provide additional information to verify such a user’s identity.

 

AFFILIATION

You understand and accept that CoHostMarket are not partner or affiliated with Airbnb INC.

 

LICENSES / PERMITS

As a CoHostMarket user, you have the responsibility of obtaining all permits and licenses necessary to operate in your field and to grant all permissions necessary under this agreement. This means that homeowners must possess all legal documentations as per their properties while co-hosts must have all required property managing licenses, as per their jurisdictions.

 

 TAXES

All users must be properly registered and are personally responsible for declaring their own taxes to the appropriate government authorities.

As Host or Co-host, you are fully responsible for the inclusion, collection, reporting, or payment, in your posted Price of all relevant taxed including without limitation VAT, sales tax, income tax, and all other applicable taxes.

 

SECURITY CONTROL SYSTEM

CoHostMarket works with appropriate security personnel to check if guests and travelers are on watch lists for regulatory, criminal or terrorism-related matters. For guests and travelers residing in the United States, we also conduct criminal record checks. You however understand and accept that no control system is perfect and a hundred percent effective. We shall thus, never be liable for any losses, harm or damages that a Property owner or Co-host may suffer based on the criminal behavior or otherwise of the guests who stay in the hosts’ properties.

 

COPYRIGHT POLICY

 All materials which without limitation may include data, articles, reports, information, representation, photos, descriptions, and any software programs uploaded to displayed on our website are copyrighted and trademarked. You understand and accept that they all are protected by intellectual property laws, except where we clearly indicate to the contrary. All titles, rights and interests relating to our website contents are owned by, licensed to or controlled by CoHostMarket.com

 

USER CONTENT/COMMUNICATION

 We will consider and treat any communication transmitted by users to our website (either by e-mail or otherwise), including but not constrained to any information, questions, comments, and suggestions as non-proprietary and non-confidential. You thereby grant CoHostMarket the right to use anything transmitted or posed by you for any purpose, including without restriction reproduction, broadcast, publication, disclosure, transmission, and posting. You must have all releases and permissions to grant us the license to use your user content, and you hereby represent that your user content does not in any way infringe any patent, copyright, proprietary rights, trademark, trade secret, or other intellectual property or proprietary rights, as well as any third party's rights to publicity or privacy, and that such user content will not lead to the breach of any relevant law or regulation.

You many not post, upload, submit or transmit any other user’s content

While any user content you provide stays your property, you grant CoHostMarket (by making available such user content) an irrevocable, international, continuous, transferrable, royalty-free license, with the rights to modify, duplicate, sub-license, distribute, publicly perform, openly show, make derivative works of, and to otherwise use the user content in any way without additional notice to or permission from you, and compensation to you.

 

SPECIFIC TERMS FOR HOSTS

These are additional terms for hosts (‘Host Terms’). They are designed specifically for property ower on the CoHostMarket. As a host, you agree that these terms govern the relationships, rules, rights, and obligations of hosts to CoHostMarket and co-hosts.

Becoming a Member: In order to become a Airbnb property manager or Homeowner looking for short term rental management, you must register for a Cohostmarket.com account by filling out the Property Owner submission form or Become Co-Host, and we will use the information received to either approve or disapprove your request to create an account on CoHostMarket as property owner or Co-Host.

Fees and commissions: As a homeowner, you will be required to pay a fee of $5 for every co-host/property manager that you hire through our services. You understand and accept that Cohostmarket.com also charges 3% percent of direct payment from a property owner. Airbnb Co-host and Property manger can withdrawl their money using Direct bank Transfer, Paypal or Payonner. 

Currency and currency conversion: Our fees are payable in US dollars. For hosts operating outside of the United States, currency conversion is made through our website.

Refunds: We do not offer any refunds for fees and commissions paid under any circumstances.

Secure payments: Our secure platform offers you the guarantee that the co-host will receive your money. You therefore agree that you will always make all payments through our platform never transfer money or pay your co-host or any other third party directly.

Non exclusivity: CoHostMarket.com  grants hosts the right to hire professional property managers both on our website and on other website and through other resources at the same time.

Obligations to co-host: Every host shall be responsible for his choice of a co-host(s). You understand and accept that CoHostMarket only has the responsibility of providing a platform where Home Owners and Co-Hosts can connect. You, and you alone, are fully and legally responsible for whom you choose to manage your property. You are also responsible for setting the fees and commissions for every co-host service. You understand that the co-host and you, and not us, shall be responsible and bear the blame for any bad review from guests arising from a co-host or your management of any such guests(s). It is your duty to agree on the responsibilities of each party i.e. how much of the reservation income will be returned to the property Owner, and how the co-host's expenses will be reimbursed.

Communication: We will facilitate the initial introduction between you and your hired co-host. You are responsible and liable for all subsequent communications. It is your responsibility and that of the co-host to jointly agree on terms of service. You must both agree, and not us, on payment terms and payment methods. You must both agree on the terms for each assignment, and Co-Host Market shall under no circumstances be a party to or liable for this agreement.

Account Innactivity: To maintain an active and engaged user base on our platform, CoHostMarket reserves the right to temporarily deactivate accounts that have not been active for an extended period of time (6 months). This policy applies to all accounts on our platform, including paid accounts (Pro and Premium).

Accounts that have not been active for a period of six months will be temporarily deactivated until the account owner verifies their email address to reactivate their account. This policy is in place to ensure the quality and safety of our platform and maintain an active user base.

Please note that temporary deactivation of an account is not a permanent termination of the account. Users can reactivate their account by verifying their email address. If the account is not reactivated within 12 Months, CoHostMarket reserves the right to permanently terminate the account.

Ads management: Cohostmarket permits hosts to allow their hired co-hosts to manage their Ads, as well as carry out certain duties as allowed by hosts as it relates to the ads, which may without limitation include accepting reservations requests, communicating with the guests, welcoming guests and updating the posted price and available dates. You agree and accept that no agreement between a Host and a Co-Host may oppose our Terms and Conditions of Payment or any other Policy relevant to the Services offered by the Host. We have all the right, and we may exercise such in our sole discretion, to restrict the number of Co-Hosts that a Host may invite for each Ad, as well as restrict the number of Ads that a Host can handle.

Due diligence: Hosts have the responsibility of exercising due diligence in the decision to hire a Co-Host to their Ad (s). As a host, you are liable for all Ads and user content posted on the Airbnb Platform created by a Co-Host on your behalf. You are also liable and answerable for your own actions, errors and omissions which without limitation includes any conduct causing harm, losses or damage to Co-Hosts.

Third party claims: Both the Host and the Co-Host are jointly and individually accountable for third party claims, which may include claims by Guests, in connection with the actions, errors and omissions of the second party in the course of accommodation activities, communication with Guests, and the provision of Co-Host Services.

Evaluation: We give Hosts the license to evaluate all hired Airbnb Co-Hosts & Property manager. Co-Host activities will not directly affect the Ratings or Comments of other Ads for which you are Host. Rather, the Host of these Ads will be evaluated by the Guests, and this evaluation may include the basis of the behavior and performance of the Co-Host. Hosts thus understand and accept that the behavior and delivery of a Co-Host may have an effect on guest Reviews and Ratings on their Ads.

Job cancelation: If both parties agree to cancel the job agreement, both parties must ensure that there are no outstanding reimbursements or commissions to be paid before the job is canceled. After cancelation, it might be impossible to request additional payment from the other party.

Termination: Unless otherwise agreed between both parties, the Host and the Co-Host may at any time terminate the agreement that binds them. Additionally, both Host and the Co-Host agree to terminate their agreement if either party so desires. At the end of the agreement between the Host and the Co-Host, the Host shall remain liable for all actions taken by the Co-Host before termination, which without limitation includes any bookings, whether current or future initiated before termination. The Host is obligated to honor all such actions, except in the case of malicious behavior or gross negligence of the Co-Host. When a user’s co-host status is terminated by us, that user will no longer be able to access any Host or Traveler information that is connected to that Host's Announcement (s).

Other legal and moral obligations: As a host on the website, we ask that you not violate the intellectual property rights of others in any way; or attack another host, co-host, or employee of Co-Host Marketplace with verbal attacks or threats of physical violence pertaining to their race, religion, politics, or gender.  Hosts must never represent themselves as someone they are not.

Indemnity: You hereby agree to shield, indemnify and hold CoHostMarket Ltd innocent against all and any costs, claims, and expenses (including but not limited to lawyer fees), and damages in connection to your use of our services.

Violation of rules: Any violation of these host rules can result in a 30-day disabling of account or deletion of account depending on the severity of the violation. We will also conduct a proper investigation to find out if violators have developed a pattern with multiple complaints. We will give you an explanation of our decision as a courtesy and not a right. Do contact us if you are verbally attacked or threatened with physical violence.  A threat of physical violence is never tolerated under any circumstance and will result in the account of the perpetrator being deleted with a ban for life. You however agree that we cannot monitor all conversations. As such, we ask that you do not automatically consider this marketplace a safe space, as human behavior is unpredictable.

Termination: You agree and accept that Cohostmarketplace.com has the full rights to either temporarily disable or permanently terminate your account if you are found to be in the violation of our rules and conditions.

 

SPECIFIC TERMS FOR CO-HOSTS

 Below are our terms for co-hosts (“CO-HOST TERMS”) which shall be construed as a legal contract between CoHostMarket and you. 

 

Becoming a host: In order to become a co-host, you must register for a CoHostMarket account by filling out the co-host submission form, and we will use the information received to either approve or disapprove your request to create an account on CoHostMarket.

Registration fees: You may register on our website by subscribing to any of our three subscription plans. They are as follows:

Option 1 – Free registration. This requires no payment. You however understand that this type of account is subject to slow approval, and we will only process your application when all other paid applications have been processed.

Option 2 – Standard paid registration ($49): This will require a payment of $49. We usually process these kinds of account within 48 hours.

Option 3 - Featured Listing Profile ($149 per year): This category of registration is usually processed within 24 hours and the account is given a featured listing status on the platform. This means that homeowners are more likely to hire you as their professional property managers.

 

You can make payment through Paypal or Stripe Gateway.

 

Currency and currency conversion: Our fees are payable in US dollars. For co-hosts operating outside of the United States, currency conversion is made through our website.

Refunds: We do not offer any refunds for fees paid under any circumstances.

Non exclusivity: CoHostMarket grants co-hosts the right to source for professional property managing opportunities both on our website and on other website and through other resources at the same time.

You understand and accept that CoHostMarket.com only has the responsibility of providing a platform where host and co-hosts can connect. You, and you alone, are fully and legally responsible for your choice of which homeowner’s property to manage. You are also responsible for setting your fees and commissions. You understand that the host and you, and not us, shall be responsible and bear the blame for any bad review from guests arising from a host or your management of any such guests(s).  It is your duty to agree on the responsibilities of each party i.e. how much of the reservation income will be returned to the host, and how the co-host's expenses will be reimbursed.

Communication: We will facilitate the initial introduction between you and your host. You are responsible and liable for all subsequent communications. It is your responsibility and that of the host to jointly agree on terms of service. You must both agree, and not us, on payment terms and payment methods. You must both agree on the terms for each assignment, and Cohost Marketplace shall under no circumstances be a party to or liable for this agreement.

Relationship between Co-Host Market  and Property Manager: You agree that the relationship between CoHostMarket and you is not a joint venture, partnership, or employment. You are on CoHostMarket as a freelancer only and cannot act on our behalf in anyway.

Responsibility to hosts: As a Co-host, you are answerable for your actions, errors and omissions when taking on the roles and responsibilities of Co-Host, which without limitation includes any conduct causing harm, loss or damage to the Host.

Third party claims: Both the Host and the Co-Host are jointly and individually accountable for third party claims, which may include claims by Guests, in connection with the actions, errors and omissions of the second party in the course of accommodation activities, communication with Guests, and the provision of Co-Host Services.

Profile Image: We are dedicated to providing a professional and high-quality platform for all our users. To ensure this, we kindly request that all service providers upload a profile image to their accounts. In order to be approved as a service provider on our platform, it is mandatory to include a professional profile image. This not only promotes a more professional atmosphere, but also helps service providers receive more requests from homeowners.

A professional profile image offers numerous benefits, including:

Building trust: A clear, high-quality image of yourself demonstrates transparency and professionalism, allowing homeowners to feel more confident in choosing your services.

Increasing engagement: Profiles with professional images tend to receive more views, messages, and requests, as they convey a sense of expertise and reliability.

Personalizing your profile: A profile image helps homeowners put a face to your name, allowing for a more personal connection and a greater likelihood of forming successful working relationships.

Enhancing your brand: A professional profile image contributes to your overall brand image and identity, helping you stand out from competitors and ensuring you make a positive first impression.

By uploading a professional profile image, you are taking an important step toward maximizing the potential of your profile and increasing your success on our platform.

Indemnity: You hereby agree to shield, indemnify and hold CoHostMarket innocent against all and any costs, claims, and expenses (including but not limited to lawyer fees), and damages in connection to your use of our services.

Other terms: Do contact us if you are verbally attacked or threatened with physical violence.  A threat of physical violence is never tolerated under any circumstance and will result in the account of the perpetrator being deleted with a ban for life. You however agree that we cannot monitor all conversations. As such, we ask that you do not automatically consider this marketplace a safe space, as human behavior is unpredictable.

Termination: You agree and accept that CoHostMarket.com has the full rights to either temporarily disable or permanently terminate your account if you are found to be in the violation of our rules and conditions.

 

EEA AND NON-EEA USERS

If your country of residence is in the European Economic Area ("EEA") or in the United Kingdom, the contract you enter into with Airbnb shall include the Terms of Service for European users. If your country of residence is outside the EEA or in the United Kingdom, the contract you enter into with Airbnb shall include the Terms of Service for non-European users.

 

THIRD PARTY SITES

We may sometimes feature links to third party websites on CoHostMarket.com. Users are advised not to take the provision of such links as a commendation of the content, your property and/or services, and procedures, of that third-party website. Users’ access and use of such linked sites are at their own risk.

 

DISCLAIMERS AND LIMITATION OF LIABILITY

THIS SITE IS PROVIDED BY CO-HOST MARKETPLACE ON AN "AS IS" AND “AS AVAILABLE” BASIS. CO-HOST MARKETPLACE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, DIRECT OR OTHERWISE, REGARDING THE WEBSITE’S OPERATION OR ITS CONTENT, MATERIALS, INFORMATION, OR DISPLAYED GOODS.

WE EXPRESSLY AND FULLY DISCLAIM ALL DIRECT OR IMPLIED WARRANTIES (INCLUDING, BUT NOT IN ANY WAY LIMITED TO INDIRECT WARRANTIES OF SUITABILITY, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) TO THE FULLEST EXTENT ALLOWABLE BY APPLICABLE LAW. WITHOUT LIMITING THE FOREGOING, CO-HOST MARKETPLACE DISCLAIMS ANY AND ALL WARRANTIES, DIRECT OR IMPLIED, FOR ANY SERVICES OFFERED ON THIS WEBSITE.

CO-HOST MARKET (ITS EMPLOYEES, OFFICERS, MANAGERS, REPRESENTATIVES, OR SALESPERSONS) SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGES ARISING OUT OF OR IN RELATION WITH THE USE OF OR THE INABILITY TO USE THE CO-HOST MARKETPLACE WEB SITE, EVEN IF CO-HOST MARKET OR A CO-HOST MARKETPLACE AUTHORIZED REPRESENTATIVE HAS BEEN INFORMED/ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

CO-HOST MARKET WILL NOT BE LIABLE FOR LOSS OF BUSINESS AND PROFITS OR OTHER SPECIAL, CONSEQUENTIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF WE ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY THIRD-PARTY CLAIM BY EXCEPT AS EXPRESSLY PROVIDED HEREIN. CO-HOST MARKET WILL NOT BE LIABLE FOR SERVICES BEING UNAVAILABLE FOR USE OR FOR CORRUPTED OR LOST SOFTWARE OR DATA.

WHILE CO-HOST MARKET USES PRACTICAL EFFORTS TO INCLUDE PRECISE AND CURRENT INFORMATION ON THE WEBSITE, WE MAKE NO REPRESENTATIONS AS TO THE WEBSITE'S ACCURACY. CO-HOST MARKET ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY OMISSIONS OR ERRORS IN THE CONTENT ON THE SITE.

WE SHALL NOT BE DEEMED RESPONSIBLE FOR THE QUALITY OF ANY PROPERTY MANAGEMENT JOB; PAYMENT OR NONPAYMENT OF DUE COMMISSIONS; THE PRESENTATION OF A PROPERTY MANAGER’S BUSINESS LICENSE AND/OR; THE VERIFICATION OF INSURANCE.

WE ARE A HOMEOWNER/PROPERTY MANAGER CONNECTION WEBSITE AND ARE NOT RECOGNIZED BY ANY CITY OR STATE AS A PROPERTY MANAGING BUSINESS. WE SHALL NOT BE HELD ACCOUNTABLE FOR LOSS OF FUNDS/RESOURCES A USER MIGHT EXPERIENCE OR ANY BAD FEEDBACK A USER MIGHT EXPERIENCE.

COHOSTMARKET MAY BE ADJUDGED TO BE LEGALLY RESPONSIBLE FOR DELIBERATE AND GRAVE MISCONDUCT BY US, OUR LEGAL REPRESENTATIVES, AGENTS OR DIRECTORS UNDER PERTINENT LEGAL PROVISIONS. THIS IS ALSO APPLICABLE TO THE PRESUMPTION OF WARRANTIES, ANY OTHER OBJECTIVE LIABILITY AND/OR IN THE EVENT OF WRONGFUL INJURY TO LIMB, HEALTH OR LIFE. CHOICE OF LAW

While we offer an international service, this agreement and any terms hereunder shall be governed by the laws of the United States, without regard to conflicts of laws rules. We will however attempt to settle disputes first through arbitration, and will only use the courts as a second resort should arbitration fail.

 

CHANGES/MODIFICATIONS

We may review, alter, or change these terms of service at any time at our discretion without giving prior notice to users. We will however send you a notification e-mail at least 30 days before the effective date. If you do not agree with the modified terms, you are advised to immediately terminate this agreement. We will always inform you of your right to terminate this agreement in our notification e-mail.

We will deem you to have accepted the amended terms if you do not terminate your agreement with us prior to the commencement date of the modified Terms and continue to use our platform and services.
